WHAT IS THE DIFFERENCE BETWEEN A MAINTENANCE CORPORATION (HOMEOWNERS ASSOCIATION) AND A CIVIC ASSOCIATION?

Since 1973, the New Castle County Code required that any community containing private open space or common facilities must have a maintenance corporation. A maintenance corporation is a legal entity consisting of homeowners within a community. The primary responsibility of a maintenance corporation is maintaining the open space and common facilities within the community.

A Civic Association is more of a "get together for the common good" to keep the community vibrant and active. It is a voluntary organization.


WHY DOES THE LEGENDS HAVE A CIVIC ASSOCIATION?

We do not own any property. The medians on East Whittington Way and West Whittington Way and the rotaries on East Whittington Way, West Whittington Way, Sheehan Drive and Casper Way belong to The Town of Middletown.


WHAT ARE THE ANNUAL DUES FOR THE LEGENDS CIVIC ASSOCIATION?

WHAT ARE MY DUES USED FOR?

The bulk of our funds are used for landscape maintenance. The Town of Middletown cuts the grass on the rotaries. They do not weed, mulch, aerate or seed. The Civic Association contracts with a landscaper to refresh the mulch, weed, trim, aerate, fertilize, and apply weed control. The Civic Association also sponsors a number of social and community activities: the annual Easter Egg Hunt, Harvest Festival Parade, Community Yard Sale, Holiday Decorations and Light Up The Legends. Events such as Brunch With Santa and a Golf Outing are adjunct programs that are typically self-funding.


WHAT IS THE DIFFERENCE BETWEEN THE CIVIC ASSOCIATION AND THE ARCHITECTURAL REVIEW COMMITTE (ARC)?

The Civic Association is the voluntary group described above.

The Architectural Review Committee was established by the Declaration of Restrictions filed by the developer of The Legends subdivision on November 3, 1997. The Deed Restrictions state that the "Architectural Review Committee ("ARC") is hereby vested with the power to adopt and amend from time to time design standards and procedures and building processes to control all buildings, structures or improvements to be placed upon any lot or other land area within The Legends, all shall review and approve or disapprove site improvements, building plans, landscaping and landscape accessories and play structures and play equipment as set forth herein, to enforce the Standards as more specifically contained within The Legends Architectural Review Standards (Standards). If any discrepancy is found to exist between the Standards and this Declaration, this Declaration shall take precedence.
